California Consumers
The California Consumer Privacy Act, as amended by the California Consumer
Privacy Rights Act (“CPRA”) requires us to explain some information using certain definitions
and categories. If you reside in California, this section applies to you and supplements our
Privacy Policy.
Notice of Personal Information Collected and

California laws and regulations require us to disclose what categories of
information we have collected in the last twelve months and what categories of information we
have “shared” or “sold” as those terms are defined under California law. We do not discriminate
against California consumers who exercise any of the rights described in this policy. If you
would like more information concerning the categories of personal information (if any) we share
with third parties or affiliates for those parties to use for direct marketing please submit a

We do not sell personal information and have not sold personal
information during the 12-month period prior to the effective date of this Privacy
Policy. We do not sell the personal information of minors under 16 years of age without
affirmative authorization if we have actual knowledge of the individual’s age.

Do Not Track Disclosure
Certain web browsers may provide an option by which you may ask your browser to inform websites
you visit that you do not wish your activities to be tracked by cookies or other persistent
identifiers, commonly called "Do Not Track Signals". Although Vitamin Shoppe Websites are
currently unable to respond to Do Not Track Signals, you may opt out of tracking activities by
following the instructions in this Privacy Policy or contacting us with the information provided
in the Contact Us section below.
Access and Deletion Rights
You have certain choices regarding your personal information, as described
below.
Access: You have the right to request, twice in a 12-month period, that we disclose
to you the personal information we have collected, used, disclosed and sold about you during the
past 12 months.
Deletion: You have the right to request that we delete certain personal
information we have collected from you.
Right to Correct. You have a right to request that we correct the personal information we have about you, subject to certain exceptions.
Right to Opt-Out of the Sale or Sharing of Your Personal Information. You have a right to opt-out of the sale or sharing of your personal information.
Right to Non-Discrimination. You have a right to exercise the above rights without being discriminated against.

Verifying Requests. To help protect your privacy and
maintain security,
we will take steps to verify your identity before granting you access to your personal
information or complying with your request. If you have an account with us, we may
verify your identity by requiring you to sign in to your account or requiring you to
respond to an email from the email address associated with your account. Whether or not
you have an account with us, we may also ask you to provide details regarding your most
recent transaction with us. In addition, if you ask us to provide you with specific
pieces of personal information, we will require you to sign a declaration under penalty
of perjury that you are the consumer whose personal information is the subject of the
request. If you designate an authorized agent to make an access or deletion request on
your behalf (a) we may require you to provide the authorized agent written permission to
do so, and (b) for access and deletion requests, we may require you to verify your own
identity directly with us (as described above).
Additional Information. If you
choose to exercise
any of your rights under the CCPA, you have the right to not receive discriminatory
treatment by us. To the extent permitted by applicable law, we may charge a reasonable

Important information about third party
devices, ISPs, websites and applications
This Privacy Policy applies solely to information collected by Vitamin Shoppe. Whenever you
click on links and banners that take you to a third party website or you use, download or
install third party software applications onto your Device, your use of those third party
websites and/or software will be subject to the third party’s privacy policies, not Vitamin
Shoppes’. We strongly suggest you to carefully read the privacy policy of any website you visit.
Notice of Financial Incentive
We provide price discounts, coupons, services and other benefits for (1) all
customers; (2)
members of our Rewards Program; and (3) members of our mailing list (collectively “Programs”).
Through these offerings, customers provide us with the necessary personal information (e.g.,
names, emails, phone numbers) when they opt-in to our programs. There is no obligation to opt-in
and customers may opt-out at any time. The detail of the Program is contained in the terms and
conditions. We offer these Programs, among other things, to enhance our relationship with you so
you can enjoy more of our products/services at a lower price. We invest heavily in our marketing
and brands, in part, so we can provide Programs to our customers. The value to our business of
customers’ personal information is dependent on specific facts such as whether and to what
extent they, in the aggregate, take advantage of any offerings and whether and to what extent
they opt-out of any offerings. Our ability to create any value from the Programs is heavily
based on our ability to leverage said intellectual properties. We do not calculate the value of
customer data in our accounting statements. To the extent we create overall value from our
Programs to our business that could be directly or reasonably related to the value of customer
data in the aggregate, the method for calculating same would include: the costs associated with
(1) our intellectual property; (2) enhancing customer data by our marketing team’s efforts; (3)
leveraging our significant investments in understanding you as our existing and future
customers; (4) all other costs reasonably related to the programs and (5) whether the sales
generated by the program(s) exceed the cost to us of offering them.
