Purchase Policy Details

If you purchase any merchandise or products (collectively, "Products") offered by The Vitamin Shoppe® on www.vitaminshoppe.com, or any mobile site, mobile app or other website on which this Purchase Policy is posted (collectively, “Sites”), the terms of this Purchase Policy shall apply. This Purchase Policy (the “Purchase Policy”) is part of, and is subject to The Vitamin Shoppe®’s Terms of Use linked here (the “Terms of Use”), and any capitalized terms used but not defined in this Purchase Policy will have the same meaning as in the Terms of Use. If you sign up for our Auto Delivery service, the payment terms for Auto Delivery orders are set forth in our Auto Delivery Terms and Conditions.

PLEASE BE AWARE THAT THE TERMS OF USE CONTAIN A MUTUAL DISPUTE RESOLUTION/ARBITRATION AGREEMENT, CLASS ACTION WAIVER, AND JURY TRIAL WAIVER WHICH APPLY TO PURCHASES YOU MAKE ON THE SITESYOUR RIGHTS. YOU AGREE TO BE BOUND BY THESE PROVISIONS. IN ARBITRATION, THERE IS NO JUDGE OR JURY AND THERE IS LESS DISCOVERY AND APPELLATE REVIEW THAN IN COURT. YOU SHOULD REVIEW THE TERMS OF USE CAREFULLY.

You acknowledge and agree that all Products purchased under this Purchase Policy are intended for personal and non-commercial use only and may not be commercially re-sold or exported by you. This Purchase Policy does not apply to commercial purchases.

I. Prices.

The prices applicable to your order will be those in place on the date the order was placed. Promotional prices and discount offers are valid only during the applicable period indicated in the promotion. Such promotional prices may not be available in physical The Vitamin Shoppe® stores. Likewise, promotional prices and discount offers offered in physical The Vitamin Shoppe® stores or on other sites may not be available through the Sites. Certain Products may not be available at all locations. Prices at physical The Vitamin Shoppe® stores or on third-party sites may vary from the prices listed on the Sites, and these stores will have no obligation to honor or match such prices. Prices are in U.S. dollars, are subject to change, and do not reflect any applicable taxes.

II. Payment Methods and Billing

If you wish to purchase Products on any of the Sites, payment may be made by credit card, debit card, gift card, or any other payment method as we may introduce on the Sites in our exclusive discretion. We reserve the right to accept or refuse any payment made in any form. To purchase Products on the Sites by credit or debit card, you must provide valid credit or debit card information as required by the applicable Site's order form. This information includes, but is not limited to, your credit card number, the expiration date of your credit card, the CVV information, your billing address and the name as it appears on the card. We currently accept the following credit or debit cards: VISA, MASTERCARD, AMERICAN EXPRESS, DISCOVER, DINER'S CLUB and JCB, which is subject to change in our exclusive discretion. By submitting such credit or debit card information (whether directly or through a mobile wallet accepted on the Sites), you give The Vitamin Shoppe® permission to charge your purchases to the card or other payment method that you designate on the order form.

You represent and warrant that (a) you have the legal right to use any credit card(s), debit card(s) or other payment method(s) submitted on the Sites in connection with any purchase of Products, (b) the charges incurred by you on the Sites will be honored by your card issuer or other payment method provider, (c) you will promptly pay for any purchase through the Sites placed by you or anyone who you allow to use your account credentials or password, and (d) the information you supply to us is true, correct and complete. We reserve the right to cancel any order, any time and for any reason.

We will not be responsible (i) for any charges that your card issuer or other payment method provider may charge you as a result of our processing of your order, (ii) if your card issuer or other payment method provider declines or fails to authorize your payment, or (iii) for any processing delays or non-delivery of Products that may arise due to any validation checks that may be carried out regarding your payment or identification. If you select the option to buy online and pick up at one of our stores, bag fees may be applied to your order upon pickup. Please bring a valid form of ID for any in-store pickup. We may employ the use of third party services for the purpose of facilitating payment and the completion of purchases of Products. Any personal information you provide to us in connection with your order is subject to our Privacy Policy. We reserve the right to refuse or cancel your order of Products if fraud or an unauthorized or illegal transaction is suspected, in our sole discretion.

III. Order Acceptance

We reserve the right, at our sole discretion, to refuse or cancel any order for any reason (including but not limited to limitations on quantities available for purchase; inaccuracies or errors in Product or pricing information; Product or ingredient restrictions mandated by local, state, national or international regulations; or problems identified by our credit and fraud avoidance group). We may also require additional verifications or information before accepting any order. Your credit card or other approved method of payment will not be charged until your payment method is authorized, the order information is verified for accuracy and your order is shipped.

We will contact you if all or any portion of your order is canceled or if additional information is required to accept your order. If your order is canceled by us after your credit or debit card or other payment method has been charged, we will issue a credit to your original payment method in the amount of the charge.

IV. Order Returns

Customers may return any opened or unopened merchandise purchased from any Vitamin Shoppe channel to any Vitamin Shoppe store within 30 days. If return unopened and accompanied by a receipt the customer will receive the return in the original form of payment. If opened and accompanied by a receipt, the customer will receive an in-store merchandise credit. If return opened or unopened without a receipt, the customer will receive an in-store merchandise credit for the lowest selling price during the prior 30 days, unless they are a Healthy Awards member in which case the store can look up a customer's purchase history to determine the price that was paid for the item (s). V. Shipping and Handling

Pricing on the Sites does not include applicable shipping costs. You will pay any shipping and handling charges specified during the ordering process. Shipping and delivery dates are estimates only and cannot be guaranteed. We are not liable for any delays in shipments.

You are solely responsible for providing us with accurate shipping information and a valid phone number or email address. Please note that refunds will not be issued for any order that is refused or abandoned at the delivery address or orders that cannot be delivered due to your failure to provide us with complete and accurate shipping information. In the event that any Product is returned to us as a result of your failure to provide us with accurate shipping information, you may be responsible for any additional shipping fees or other charges that we incur in connection with the return of the Product to us or in re-sending the Product to you.

Ownership and risk of loss of the Products will pass to you immediately upon our delivery of the Products to the common carrier.

VI. Pricing or Typographical Errors

We work hard to provide accurate Product and pricing information. However, pricing or typographical errors may occur. In the event that an item is listed at an incorrect price or with incorrect information due to an error in pricing or Product information, The Vitamin Shoppe® shall have the right, at our sole discretion, to refuse or cancel any orders placed for that item. If an item is incorrectly priced, we will either contact you for instructions or cancel your order and notify you of such cancellation.

VII. Quantity Limits and Items for Resale

(a) Quantity Limits. The Vitamin Shoppe® reserves the right to limit the quantity of items purchased per person, per household or per order. These restrictions may be applicable to orders placed by the same account, the same credit card, and also to orders that use the same billing and/or shipping address. We will provide notification to the customer e-mail and/or billing address provided should such limits be applied if we cancel an order.

(a) Reseller Certificates/Sales Exempt Transactions. Transactions that are exempt from sales tax because you hold a valid reseller certificate may not be made on the Sites. Such transactions may only be made in store or by contacting Customer Care and are subject to certain limitations as imposed by us in our sole discretion, including restrictions on item quantity. This means that bulk orders that are exempt from sales tax are not permitted on this Site.

VIII. Bulk Purchases

(a) General. A “Bulk Purchase” means (a) any order for $200 or more, or any combination of orders on the Sites that, in the sole discretion of The Vitamin Shoppe®, are related and total $200 or more or (b) any store or transaction on the Sites that has more than 10 units per item, excluding purchases intended for resale. Bulk Purchases take additional time to process and may take longer than 3-5 business days to receive. Auto delivery program discounts cannot be applied to Bulk Purchases. GHOST products are not eligible for Bulk Purchases, and any such orders will be subject to cancellation. In the event of a conflict between the terms of this Section VIII and any other Section in this Purchase Policy or in the Terms of Use, the provisions of this Section VIII shall control.

(b) No Invoices. The Vitamin Shoppe® will not provide any invoices for Bulk Purchases. Please be sure to keep your shipping confirmation emails, as they will be your only proof of purchase.

(c) Freight Shipment - Due to the size and the total weight of Bulk Purchases, we may need to ship your order with a freight carrier as palletized freight, in our sole discretion. This is based on the inventory in our distribution centers and is not guaranteed. Please be advised that shipments may also come separately in traditional boxes. Before placing your Bulk Purchase, you must confirm that the ship-to address can accept both palletized freight and traditional boxes. The ship-to address cannot be changed once the order is submitted. After placing your Bulk Purchase, The Vitamin Shoppe® will contact you to confirm certain details, including whether you will need a lift gate and/or the full name and phone number of the best contact for the ship-to address for the carrier to contact to schedule delivery, or in the event the carrier has any questions related to delivery. Once you provide the above information, if your order is shipping with a freight carrier, the carrier will contact you directly to set up a delivery date and time. Once the delivery date and time are confirmed, you and/or your ship-to facility will commit to the confirmed date. We reserve the right to charge you storage fees in the event you reschedule a Bulk Purchase delivery or such delivery needs to be rescheduled because the Products could not be delivered to your ship-to address on the confirmed date. The Vitamin Shoppe® is not responsible for any fees associated with shipping or storage of your Bulk Purchase.

(d) Expiration or Best By Dates - Product shipped for your Bulk Purchase will arrive to you at least 90 days prior to any expiration or best by date noted on the label.

(e) Returns. You recognize and accept that Bulk Purchases are not subject to our Return Policy. Bulk Purchases are FINAL SALE and any attempt to return or refuse acceptance of goods following purchase will result in a forfeiture of any monies paid, due or owing, and may include additional charges and costs related to the incidental and consequential damages incurred by us in shipping and resale of the goods. Any damages or shortage related to a Bulk Purchase must be reported within 48 hours of receipt to our Bulk Purchase department: bulkorders@vitaminshoppe.com

IX. Additional Terms

Additional terms relating to certain Products (such as prices, methods of payment, our policies with respect to returns, refunds, and cancellations and/or exchanges) may be posted the Sites, including on the pages describing the Products.
