Welcome to the Terms and Conditions (“Auto Delivery Terms”) for our Auto Delivery program. These Auto Delivery Terms are between you and The Vitamin Shoppe, LLC and/or its affiliates (“The Vitamin Shoppe,” “we” or “us” or “our”). These Auto Delivery Terms constitute the entire agreement between you and The Vitamin Shoppe relating to Auto Delivery. Please note that your use of The Vitamin Shoppe website is also governed by The Vitamin Shoppe Terms of Use, which contain a mutual dispute resolution/arbitration agreement, class action waiver, and jury trial waiver that affect your rights (“Terms of Use”), as well as all other applicable terms, conditions, limitations and requirements on The Vitamin Shoppe website, all of which are incorporated into these Auto Delivery Terms. Benefits of Auto Delivery
Auto Delivery is a product subscription service that allows subscribers to subscribe for the recurring delivery of eligible products or services, as determined by The Vitamin Shoppe in its sole discretion. By utilizing Auto Delivery, you acknowledge that you have read, understood, and agree to be bound by these Auto Delivery Terms.
There is no extra cost to participate in Auto Delivery. Subscribers may receive a discount on their initial Auto Delivery purchase and future recurring orders and may enjoy free shipping on all recurring Auto Delivery orders of a minimum subscribed amount.
The Vitamin Shoppe reserves the right to change the Auto Delivery benefits, including the discount amounts and eligibility used to determine discount amounts or minimum subscribed amount for free shipping, at any time in its sole discretion.
Renewal, Payment, and Cancellation
We will automatically fulfill your Auto Delivery subscription order according to your chosen delivery schedule. Your subscription will continue and your payment method will be charged until you cancel the Auto Delivery subscription.
The price for an Auto Delivery subscription item is stated on the applicable product detail page. The total cost charged to your payment method for each Auto Delivery subscription order will be the cost of the item (as described below) on the day that order is processed (which is subject to change) less the Auto Delivery subscription discount, plus any applicable sales tax, shipping charges and fees. If you have authorized us to apply Healthy Awards® Cash Back Awards to future Auto Delivery orders, your Healthy Awards® certificate(s) may be applied toward the balance of your order before charging any remaining balance on your payment method. Your Auto Delivery order must be of equal or greater value to your Healthy Awards® certificate(s) in order to be auto applied. If the Auto Delivery order value is less than your Healthy Awards® certificate(s), then your certificate(s) will not be applied and will still be available to you to use at a later time.
We may change the price for an Auto Delivery subscription at any time for any reason. Information about changes to price will be available to you on the My Auto Delivery page. The item price and any applicable discount for your order is calculated before your email reminder. The price of the item may decrease or increase between deliveries, but will never be higher than the price shown in your email reminder.
You may be able to price match your initial order based on our price match policy outlined in the, "What is your price matching policy?", section of our site. However, you cannot price match on subsequent deliveries of your recurring orders.
The total cost for each Auto Delivery subscription order will be charged to the payment method used to create your subscription or as otherwise directed by you. If we are unable to complete your Auto Delivery subscription order with the payment method you used to create your subscription, we will not process your Auto Delivery subscription order. Each charge will be submitted for payment on the date that your item ships.
You may cancel your Auto Delivery subscription at any time or skip your next delivery until one day before the shipment date via the My Auto Delivery page. Visit the My Auto Delivery page to view your upcoming shipment date(s). To cancel, select the item you wish to cancel on the My Auto Delivery page, select Cancel Item and then select Cancel. If you signed up for Auto Delivery in a store and prefer not to make changes online, you may make changes or cancel your subscription by visiting the store. If you signed up for Auto Delivery by telephone and prefer not to make changes online, you may make changes or cancel your subscription by calling Customer Support at 866-293-3367.
If you cancel your subscription and then reactivate it, the discount applied to any Auto Delivery item may not be the same discount in effect at the time of cancellation. If the Auto Delivery discount percentage for such item changes, the new discount will be applied to your future shipments of that item.
You cannot pay for Auto Delivery subscription orders with an Electronic Benefits Transfer (EBT) card for the Supplemental Nutrition Assistance Program (SNAP), because a PIN identification is required before each purchase.
Gift Cards may only be used on your initial Auto Delivery purchases. A credit card or PayPal account is required for future recurring Auto Delivery orders, so we’ll ask for one at checkout, even if you pay for your initial purchase with a gift card.
Eligible Products/Limitations
Only items identified by icons, buttons, links or other selectable features titled as “Auto Delivery” or other similar language are eligible for Auto Delivery. Replenishment order discounts cannot be combined with other discounts. Auto Delivery discount may not be applied to gift card purchases or bulk orders. Future replenishment orders are limited to 4 per item.
If you select an item that becomes temporarily out of stock, we’ll send you an email notifying you if an item in your upcoming subscription order is out of stock and provide recommendations for similar items. You can swap any of these for your out-of-stock item by clicking on a product or “View More”. The order date, frequency and quantity won’t change. In the meantime, we’ll continue trying to fulfill your order and let you know if it becomes available again. You will not be charged if the item is not shipped. If you select an item that becomes permanently discontinued, we will cancel your subscription for that item.
Your participation in Auto Delivery is personal to you, and you may not transfer, assign, or resell your subscription or any of the benefits to any third party without our authorization.
We reserve the right to not ship you a subscription shipment for one or more subscription periods. We won't charge you for any skipped shipments.
Termination by Us
We may terminate your Auto Delivery subscription at our discretion without notice. If we do so after you have been charged a subscription price but prior to our shipment of the subscription shipment for that subscription period, your subscription will be canceled and we will give you a refund of the applicable subscription price for that subscription period. However, we will not give any refund for termination related to conduct that we determine, in our discretion, violates these Auto Delivery Terms, our Terms of Use, or any applicable law, or involves fraud or misuse of any Auto Delivery subscription. Our failure to insist upon or enforce your strict compliance with these Auto Delivery Terms or our Terms of Use will not constitute a waiver of any of our rights.
Returns and Refunds
All returns and refunds of Auto Delivery subscription shipments are subject to The Vitamin Shoppe Returns policy.
Agreement Changes
We may, in our sole discretion, change these Auto Delivery Terms (including all applicable terms, conditions, limitations and requirements on The Vitamin Shoppe website), without notice to you. If any change to these terms is found invalid, void, or for any reason unenforceable, that change is severable and does not affect the validity and enforceability of any remaining changes or conditions. YOUR CONTINUED PARTICIPATION AFTER WE CHANGE THESE TERMS CONSTITUTES YOUR ACCEPTANCE OF THE CHANGES. IF YOU DO NOT AGREE TO ANY CHANGES, YOU MUST CANCEL YOUR AUTO DELIVERY SUBSCRIPTION(S).
